The terms and conditions apply to the rights and obligations arising from purchases of goods by HOUM.ee e-shop customers (hereinafter Client) and HOUM Design OÜ (hereinafter HOUM.ee).
When registering and/or purchasing products for HOUM.ee, the terms of this agreement apply and, in addition to these conditions, the legal relations arising from the purchase of products from the HOUM.ee e-shop are governed by the Law of Obligations Act, the Consumer Protection Act and other legislation.
E-shop HOUM.ee reserves the right to make changes to the terms of sale. These changes are reflected on the website www.houm.ee.
2. IMPLEMENTATION OF THE SALE AGREEMENT
HOUM.ee sells and the Client buys the products offered in the e-shop.
HOUM.ee and the Client will enter into a sales contract from order confirmation with payment to HOUM Design OÜ bank account.
At HOUM.ee e-shop, when ordering and paying for the order, the Client confirms that he has read and agreed to the terms of sale.
All prices in the HOUM.ee e-shop are in Euro and include VAT 20%.
The price of the transport is added according to the chosen delivery method of the Client (Omniva parcel terminal, Omniva courier).
If the order is submitted before changing the terms of sale or prices, the legal relations that occurred between the Client and HOUM.ee apply to the conditions existing at the time of the order.
E-shop HOUM.ee reserves the right to make changes in sales prices. These changes are reflected on the website www.houm.ee.
4. COMPLETING THE ORDER AND RECEIPT OF THE PRODUCTS
Add the desired items to the basket.
To complete the order, click on the “Checkout” in the shopping cart.
On the order completion page, fill in the required fields, select the appropriate delivery method for your products and the payment method (bank link, credit card) and click on “Pay”.
The sale contract enters into force after order confirmation with payment to HOUM Design OÜ bank account.
We will then send a confirmation of purchase to the e-mail address of the Client on the order.
Fill out the details on the order confirmation page, because from accuracy and correctness of the provided information depends the speed and smooth delivery of the products you buy, and the subsequent resolution of disputes and complaints.
E-shop orders are handled on weekdays (Mon-Fri 10:00-15:00). If the order is submitted after 15:00 on Friday, the order will be completed on the following Monday.
After the sele contract enters into force HOUM.ee will complete the order and transfers it to the logistics partner.
Products in the warehouse reach the customer within 2-5 days and ordered products within 3-5 weeks.
On the HOUM.ee website the delivery deadlines are displayed from the moment the order is received at the HOUM.ee bank account.
Delivering without delay requires diligent and accurate submission of delivery data when entering the order. HOUM.ee is not responsible for delays in delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy of the information provided by the Client on the order formulation.
E-shop HOUM.ee is not responsible for the delivery of products if the goods are delivered to the logistics partners at the right time, but the delivery is due to circumstances that the e-store HOUM.ee could not influence or anticipate.
In accordance with § 56 (1) of the Law of Obligations Act, the Client has the right to withdraw from the contract within 14 days from the receipt of the products.
Returned products must be in unused, undamaged and in original packaging.
The cost of returning the products is borne by the Client, unless the reason for the return is non-conformity to the order or defective goods.
In order to return, an application for returning the products must be submitted to e-mail firstname.lastname@example.org within 14 days from the receipt of the goods. The return application must contain the Clients name, the name of the product and the invoice or order number.
Cash for returned products is reimbursed to the Client immediately, but not later than 14 days after the receipt of the cancellation application. In addition to the cost of returned products, the cost of delivery of the goods will also be refunded.
7. PROCEDURE FOR PROCEEDINGS
In accordance with the Law of Obligations Act, the Client has the right to complain about the non-conformity of the contractual terms that appeared on the product within 2 years from the receipt of the products, during the first six months of the defect it is presumed that it existed at the moment of purchase and the defects nature must be ascertained by the seller.
Upon occurrence of product defect, the Client undertakes to inform HOUM.ee about the problem by e-mail to email@example.com and provide the following information: name, contact details and product shortage. The corresponding application must be sent not later than within 2 months from the discovery of the defect.
HOUM.ee is not responsible for:
Product damage or neglected damage caused by Client
Defects caused by improper use of the product
The natural physical wear of the product when used normally
8. FORCE MAJEURE
E-shop HOUM.ee is not responsible for damage or delivery of the products to the Client if the damage or delivery of the goods is due to circumstances that the e-store HOUM.ee could not influence or foresee.
By using the website HOUM.ee, the Client gives consent to the processing of his/hers personal data. Read more about privacy.
HOUM.ee uses the information provided by the Client only to fulfill the Clients purchase order and does not disclose it to third parties.
10. OTHER CONDITIONS
Disagreements and disputes arising from compliance with these conditions are settled by the parties in particular through negotiations. If the contractual disputes can not be resolved by negotiations between the parties, then the Client has the right to turn to the Consumer Protection Board or the court for protection of his rights. HOUM.ee has the right to appeal to court for the protection of its rights.
